LaunchPulse is a product of Basekick Labs LLC, a limited liability company organized in the State of Delaware, United States ("Basekick Labs", "we", "us"). These terms govern your use of LaunchPulse. By creating an account or using the service, you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind it.

1. The service

LaunchPulse collects analytics events from websites and applications you control and presents them as dashboards, insights, alerts, and reports. We may add, change, or remove features over time. If we plan to remove something you rely on, we will give reasonable notice.

2. Your account

You must provide accurate account information and keep it current.
You are responsible for everything that happens under your account, and for keeping your password, API keys, and second factors secure.
You must be at least 16 years old, or the age of digital consent where you live.
Tell us promptly at hello@launchpulse.dev if you believe your account has been compromised.

Your public key is designed to be visible in your website's source code. Your secret key is not: keep it server-side. You are responsible for events sent using your keys.

3. Plans, billing, and trials

LaunchPulse is offered on a single paid plan, billed monthly or annually at the prices shown on our pricing page.
New accounts start with a 14-day free trial that does not require a payment card.
Subscriptions renew automatically at the end of each billing period until cancelled.
You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current paid period; we do not provide pro-rated refunds for partial periods.
If a payment fails, we will retry it and may suspend dashboard access until payment succeeds.
We may change prices with at least 30 days' notice by email. Price changes never apply to a period you have already paid for.
Prices exclude any taxes we are required to collect.

When a subscription lapses, we keep collecting your data. Access to dashboards is what pauses — your history is waiting for you when you resubscribe. We may delete data from long-inactive, unpaid accounts after giving notice by email.

4. Acceptable use

You agree not to:

Install the tracker on a site or application you do not own or have permission to measure.
Send us sensitive personal data — government identifiers, financial account numbers, health data, precise location, or special-category data under applicable law.
Use LaunchPulse to track individuals covertly where they have a reasonable expectation of privacy, or in a way that breaks the law that applies to you.
Attempt to breach or probe our security, bypass rate limits, or interfere with the service.
Resell the service, or use it to build a substantially similar competing product.
Send deliberately fraudulent or automated events designed to distort data, ours or anyone else's.

We may throttle, suspend, or terminate accounts that violate these rules or that place an unreasonable load on the service. Where practical, we will contact you first.

5. Your data and your responsibilities

Your analytics data is yours. We claim no ownership over it. You grant us the limited licence needed to store and process it in order to run the service for you.

Because you decide what the tracker sends, you are responsible for your own compliance obligations: telling your visitors what you collect, obtaining any consent your jurisdiction requires, and honouring your visitors' rights. Our privacy policy describes exactly what the product collects so you can document it accurately.

6. Availability

We work to keep LaunchPulse available and reliable, but we do not offer a formal uptime guarantee on the standard plan. The service may be unavailable during maintenance, or because of failures outside our control. Analytics collection and dashboard availability are separate systems: a dashboard outage does not necessarily mean events were lost.

7. Third-party services

LaunchPulse relies on third parties such as Stripe for payments and Mailgun for email, and can deliver alerts to endpoints you configure, including third-party chat services. We are not responsible for those services, and your use of them is governed by their own terms.

8. Termination

You may stop using LaunchPulse and close your account at any time. We may suspend or terminate your account if you materially breach these terms, if required by law, or if we discontinue the service — in which case we will give you reasonable notice and an opportunity to export your data. On termination, your right to use the service ends immediately.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that analytics data will be complete or perfectly accurate. Analytics inherently miss traffic — ad blockers, disabled JavaScript, and network failures all cause undercounting. Do not rely on LaunchPulse as a system of record for billing, invoicing, or legal purposes.

10. Limitation of liability

To the maximum extent permitted by law, Basekick Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to these terms will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your use of the service, your data, or your breach of these terms — including claims that your collection of end-visitor data was unlawful.

12. Changes to these terms

We may update these terms as the service evolves. The "last updated" date above reflects the current version, and we will notify customers by email of material changes. Continuing to use LaunchPulse after a change takes effect means you accept the updated terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You and Basekick Labs LLC agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these terms or the service.

If any provision of these terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between you and Basekick Labs LLC regarding the service.
